What is a §1031 Exchange?
A §1031 Exchange is a tax-deferred exchange of real property which allows the deferral of capital gains. An exchange is available for the purchase and sale of real property held for investment or business purposes. Personal residences do not qualify for an exchange.
Timing is Crucial
An Intermediary (Big Sky Exchange, Inc.) must be designated and the exchange must be set up prior to the sale of the property. From the sale of the property, the exchangor has 45 days to identify replacement properties and also 180 days to close on the properties that are identified.
